Please read this Privacy Policy before using the website www.pimenta.bg. This policy aims to inform you how “Pimenta Bulgaria” EOOD processes the personal data of representatives, employees, and contact persons of its business partners (B2B clients).

The owner of the website www.pimenta.bg is “Pimenta Bulgaria” EOOD, registered in the Commercial Register with UIC 202473299, with its registered office and management address at: Sofia, 5 Balcho Neykov Str. This Privacy Policy has been prepared and is based on the current Bulgarian legislation on personal data protection and Regulation (EU) 2016/679 (GDPR).

1. Scope and Applicability (B2B Nature of the Platform)

The website www.pimenta.bg is a platform entirely oriented towards business users (B2B relationships) – legal entities, sole proprietors, and manufacturing enterprises.

In this context, “Pimenta Bulgaria” EOOD collects and processes personal data only to the extent necessary for identification, communication, and execution of commercial agreements with the representatives, managers, authorized persons, or contact employees of our business clients.

2. Types of Data We Process

Depending on the specific commercial purposes, the Controller processes the data listed below either independently or in combination with each other:

2.1. Identification and Business Contact Data, necessary for concluding and executing contracts and wholesale orders:

  • Full name of the legal representative of the company or the authorized contact person;
  • Business address for the delivery of raw materials and products;
  • Business phone number and email address for communication;
  • Data regarding payments made from/to the legal entity that contain personal information (e.g., ordering party details).

2.2. Data Generated in the Course of the Business Partnership:

  • Commercial contract number, waybill number, client number, specifications for custom manufacturing recipes (including toll manufacturing);
  • Data required for issuing invoices under the Accountancy Act (names of the materially responsible person/compiler);
  • IP address, device type, operating system, and browser type when visiting our B2B portal;
  • Order history, frequency of orders, and email communication regarding technical support from our specialists.

Important: The Controller does not collect or process special categories of (sensitive) personal data. Individuals must not provide such data. In the event of accidental provision, it will be deleted immediately.

3. Purposes and Legal Grounds for Processing

In accordance with the B2B profile of our activity, we do not require explicit consent for data processing with every order. Data is processed based on the following legal grounds:

  • For the performance of pre-contractual and contractual relations (Art. 6, Para. 1, Item “b” of the GDPR): For B2B account registration, processing orders for spices and seeds, manufacturing according to customer recipes, and delivery to your facility (shop, restaurant, factory).
  • For compliance with legal obligations (Art. 6, Para. 1, Item “c” of the GDPR): For accounting purposes, issuing tax invoices, and for the needs of tax and social security control (National Revenue Agency – NRA).
  • Based on legitimate interest (Art. 6, Para. 1, Item “f” of the GDPR): For operational communication with the employees and contact persons of our partners, for improving the functionality of the B2B website, and for ensuring the security of our platform.

4. Data Processing Principles

The Controller strictly adheres to the principles of GDPR: lawfulness, transparency, purpose limitation, data minimization, accuracy, storage limitation, and a high level of security and confidentiality.

5. Data Sharing with Third Parties

For the purposes of business relations, data may be shared solely with:

  • Courier and transport companies (for delivery of raw materials and spices to your facility);
  • Banking institutions and payment operators (for processing corporate payments);
  • Accounting firms or auditors serving the Controller;
  • State authorities (NRA, CPA, courts) upon legal request.

6. Data Retention Period

  • 6.1. Personal data contained in accounting documents, invoices, and commercial partnership agreements is stored for a period of 10 years, starting from January 1 of the year following the year to which they relate (in accordance with the requirements of the Tax and Social Security Procedure Code and the Accountancy Act).
  • 6.2. Data processed for the maintenance of the B2B profile in the online store is stored for a period of 5 years from the partner’s last active action on the site or until the profile is closed.

7. Information Security

We apply modern technical and organizational measures (including SSL encryption of the connection) to protect B2B profiles from unauthorized access. Since you, as business partners, have access to wholesale price lists, it is your responsibility to safeguard your username and password and to inform us immediately in case of suspected misuse.

8. Your Rights as a Data Subject

Every individual whose data is processed within our B2B relations has the following rights under the GDPR:

  • Right of access and a copy of the data;
  • Right to rectification of inaccurate or outdated contact data;
  • Right to erasure (the “right to be forgotten”), unless the data is necessary for a pending contract or accounting purposes (the 10-year statutory period);
  • Right to restriction of processing;
  • Right to data portability;
  • Right to object to processing based on legitimate interest;
  • Right to lodge a complaint with the Commission for Personal Data Protection (CPDP).

9. Mandatory and Voluntary Nature of Data Provision

Providing business contact data and company identification is voluntary but is mandatory for entering into commercial relations. Without it, “Pimenta Bulgaria” EOOD will not be able to accept, fulfill, and deliver your wholesale order or manufacture products according to your recipe.
